While other governors like our own Gov. Joe Manchin are playing politically-correct puppets like cowards and complying with REAL ID, to kiss up to the federal powers (for political ambitions?), the governor of Montana is standing up boldly like a man (consistent with his oath of office) for the Constitution, State's Rights, 4th amendment privacy of their citizens and challenging what he called the "bluff" of the Federal government with its threats of "special treatment" beginning May 11th for those whose states are rejecting REAL ID (see earlier post).
West Virginia almost joined seventeen other states that have passed measures against REAL ID as well when the Senate passed bipartisan bill 248 with only three dissenting votes until the governor's lobbying got it stalled in House committee without an up or down vote. The governors and legislators of Maine and New Hampshire have made it clear they will not bow to federal threats or coercion against their citizens (by arbitrary and unconstitutional treatment) either that are being used to intimidate to force REAL ID upon the states.
The governor of Montana should be an example to Gov. Manchin, and the government and people of West Virginia. As Ronald Reagan stated once,
"All of us need to be reminded that the federal government did not create the states; the states created the federal government".
Therefore the sovereignty of the states, demonstrated in their creation and limiting of federal powers, is the chief defense in preventing federal despotism, particularly effecting citizens rights and privacy.

The Constitution (the supreme law sworn to by both democrats and neo-republicans) makes no provisions for a national healthcare system, which also invades state's rights, and forms communist collectivism ("it takes a village") rather than preserving liberty and freedom. This was proposed in the past, and no doubt, would lead to a national ID card (as all insurance requires), while we are already trying to remove REAL ID from the neoconservative side. (We are surrounded by communist socialism on the left and by fascism from the neo-republicans on the right). A dictatorial, paternal government is contrary to freedom and individual liberty.
This is precisely how Roosevelt's communist Social Security system (government theft by force) was implemented as well, just another national insurance program. The details do not matter. HillaryCare represents communist, socialist government akin to Canada and the UK. If people want to live under that paternal system they should move there instead of trying to change America. America needs change, but not this kind.
Here is what Cato Institute has just released on the subject. Anytime the government "requires" you to do something "for your own good" you are not free.
"Democratic presidential candidate Hillary Rodham Clinton is unveiling a sweeping health care proposal Monday thatwould require everyone to carry health insurance and offer federal subsidies to help reduce the cost of coverage," reports the Associated Press. "Fulfilling a pledge to bring health care to all, Clinton's 'American Health Choices Plan' has a price tag of about $110 billion per year. It represents her first major effort to achieve universal health coverage since 1994, when the plan she authored during her husband's first term collapsed."
In a statement issued today on the Clinton health proposal, Michael Tanner, Cato's director of health and welfare studies, writes: " Here we go again. HillaryCare is back, and its apparent that Sen. Clinton has learned little since the American people overwhelmingly rejected her last attempt to overhaul the U.S. health care system. Once again her plan, which would cost $110 billion per year in new taxes, calls for greater government control over American health care. If her plan were to pass this time, it would mean higher taxes, lost jobs, less patient choice, and poorer quality health care."
Jerome Corsi was interviewed Wednesday on WCHS 58Live talk radio by Michael Agnello over his new book exposing the very real and secretive plan implemented by the Bush administration for a North American Union. This was an excellent interview and something we had encouraged in our earlier article here that is worth reviewing again:

Agnello admitted that he thought that what he had read about a North American Union was a bunch of "conspiracy huey" and was startled to find out that it is well documented and true. This refreshing admission deserves to be considered by all republicans on other topics as well. This awakening demonstrates again the dangers of partisanship (when all swear to defend and uphold the Constitution as a standard) which blinded republicans for too long to a neoconservative and CFR serving President (and Vice President and neocon administration) who holds the U.S. Constitution in contempt, and why blogs like this are adamant about the constitution being the basis for political judgments and not party labels or "conservative" rhetoric. Hopefully other conservatives and republicans will awaken to this very real and destructive agenda which threatens the independence and sovereignty of the United States and the final demolition of the Constitution by the globalists and pragmatists. This also sheds light on large, particularly international corporations, often too much applauded for "bringing new jobs" and being wooed by state governments, who incentivize them in desperation while subsidizing the destruction of local small businesses and creative entrepreneurs. (There should be more applause for local start up companies than for bringing Toyota to West Virginia).
This is a huge and primary issue that merits the attention of West Virginians! And Dr. Corsi, upon a question from Agnello of who in Washington was trustworthy and "ahead of the curve" in opposing this agenda, mentioned in no uncertain terms, with very strong implications, just who could be trusted on this issue. In his reply he named Ron Paul, Tom Tancredo, and Duncan Hunter, respectively, and in that order. The implication for republican voters in the primary is very clear, namely, that the "lead candidates" (supported and publicized by the major news networks and their debates) in the 2008 presidential race, Rudy Giuliani, Mitt Romney, and even the unannounced Fred Thompson ARE NOT candidates who are on top of or oppose this anti-sovereign, anti-constitutional agenda of merging Mexico, the U.S., and Canada into an American EU! By implication the so-called early "lead" republican candidates would continue the agenda of the Bush administration, and so would the Democrats as well! Again, popularity thus far appears to be too much on the superficial image and ear-tickling soundbites than on solid, well-considered issues.
Ron Paul's positions, as Dr. Corsi mentioned, on this are well documented. On the NAFTA Superhighway, and being a Congressman from Texas (and opposing strongly all illegal immigration) he states this, hotly opposing it in his typical and principled constitutionally consistent manner:
The proposed highway is part of a broader plan advanced by a quasi-government organization called the “Security and Prosperity Partnership of North America,” or SPP.
The SPP was first launched in 2005 by the heads of state of Canada, Mexico, and the United States at a summit in Waco.
The SPP was not created by a treaty between the nations involved, nor was Congress involved in any way.Instead, the SPP is an unholy alliance of foreign consortiums and officials from several governments.One principal player is a Spanish construction company, which plans to build the highway and operate it as a toll road.But don’t be fooled: the superhighway proposal is not the result of free market demand, but rather an extension of government-managed trade schemes like NAFTA that benefit politically-connected interests.
The real issue is national sovereignty.Once again, decisions that affect millions of Americans are not being made by those Americans themselves, or even by their elected representatives in Congress.Instead, a handful of elites use their government connections to bypass national legislatures and ignore our Constitution-- which expressly grants Congress the sole authority to regulate international trade.
The ultimate goal is not simply a superhighway, but an integrated North American Union--complete with a currency, a cross-national bureaucracy, and virtually borderless travel within the Union.Like the European Union, a North American Union would represent another step toward the abolition of national sovereignty altogether.

Ron Paul is a voice in the wilderness when it comes to the republican 2008 Presidential candidates who ignore and duck this important issue (as they also do on their 2nd Amendment records and abortion) that effects American's "way of life" and security. Again, consistency in adherence to rule of law by the Constitution make him a trustworthy and consistent defender of national sovereignty and opposition to illegal immigration.
Ron Paul vehemently criticized the recent immigration bill pushed by the administration, refuting Bush's claim stating Amnesty Opponents are not Un-American.
Although action in the United States Senate this week has slowed passage of the amnesty bill, it is not yet dead as President Bush remains committed to this approach.That is why the President recently suggested that those of us who oppose amnesty for illegal immigrants are unpatriotic. Those of us who strongly oppose the new immigration reform bill before the Senate “don't want to do what's right for America ,” the president said. I reject that assessment as unfair and inaccurate.
Supporters of the amnesty bill like to claim that border protection is their first priority.But if enforcement of our borders is the highest priority, certainly a much shorter bill could have been written.Even better, why not enforce existing laws? According to our Constitution, Congress makes the laws that the executive branch is to enforce. The rush to pass this new law seems to obfuscate this simple fact. There are plenty of laws already in place, so it seems sensible to largely solve this problem without new laws.
To make matters worse, as I wrote in a recent column, some 120 of our best trained border guards are going to be sent to Iraq to help them with border enforcement!In addition, National Guard troops participating in Operation Jump Start on the Mexican border are scheduled to also be sent to Iraq and Afghanistan .
He also demonstrates how the Bush administration has intertwined and pushed the illegal immigration "amnesty bill", a National ID (REAL ID), and SPP plan and how they are all related.
Although the “reform” of immigration in the amnesty bill is enough to cause alarm, other highly troubling provisions are tucked away that will serve to undermine our sovereignty and weaken our civil liberties.According to the most recent version of the Senate bill, the misnamed Security and Prosperity Partnership for North America is to be “accelerated.”It seems ironic that a project aiming to actually weaken US borders with Mexico and Canada would be added into a bill that purports to toughen border controls.
Also, this bill will bring us closer to a national ID card, which without a doubt runs counter to American values and history and will punish American citizens without doing much to counter those who would come here illegally.
Ron Paul is the only candidate who completely rejects and exposes the danger of all these elements for Americans. Politicians and candidates who take oaths to uphold the constitution as rule of law must take the same positions consistent with it. (See our side column links against North American Union).

The time is long overdue to look behind the curtain to see just why the almost 300 page Bush-Kennedy-McCain bill for immigration was so strongly supported, almost driven and coerced as much as the unread USA PATRIOT ACT(s), with the strongest rhetoric, by this so-called "republican" President. This issue of illegal immigration has puzzled many loyal Bush supporters because they do not see just who and what is behind a very clear inconsistency with both constitutional sovereignty and conservative policy for a rule of law. We republish that article below for the reader to see just what is behind the Bush policy which directly explains just why such a loose policy of illegal immigration is desired, which, as usual, is tied directly to Economic Pragmatism toward a global economy. (Yes, this is what NAFTA is all about too, and Council of Americas, and even more quiet Organization of American States--where the "states" are other countries!) . There you will find the true nature of Bush government revealed (if somehow you have not yet heard), including the elements of the self-professed Neoconservatives (who "fixed intelligence--falsified evidence of WMD--around the policy to go to war" from the rogue Office of Special Plans), the Council on Foreign Relations (CFR), and others of various other organizations whose commitment is toward a one world government, and gradual erasure of sovereignty and borders, toward a World Federation of Democracies, their Utopian ambition. Despite having no authorization from Congress, the Bush administration has launched extensive working-group activity to implement a trilateral agreement with Mexico and Canada.
The membership of the working groups has not been published, nor has their work product been disclosed, despite two years of massive effort within the executive branches of the U.S., Mexico and Canada.
The groups, working under the North American Free Trade Agreement office in the Department of Commerce, are to implement the Security and Prosperity Partnership, or SPP, signed by President Bush, Mexican President Vicente Fox and then-Canadian Prime Minister Paul Martin in Waco, Texas, on March 23, 2005.
The trilateral agreement, signed as a joint declaration not submitted to Congress for review, led to the creation of the SPP office within the Department of Commerce.
The SPP report to the heads of state of the U.S., Mexico and Canada, -- released June 27, 2005, -- lists some 20 different working groups spanning a wide variety of issues ranging from e-commerce, to aviation policy, to borders and immigration, involving the activity of multiple U.S. government agencies.
Geri Word, who heads the SPP office within the NAFTA office of the U.S. Department of Commerce affirmed to WND last Friday in a telephone interview that the membership of the working groups, as well as their work products, have not been published anywhere, including on the Internet.
Why the secrecy?
"We did not want to get the contact people of the working groups distracted by calls from the public," said Word.
She suggested to WND that the work products of the working groups was described on the SPP website, so publishing the actual documents did not seem required.
WND can find no specific congressional legislation authorizing the SPP working groups. The closest to enabling legislation was introduced in the Senate by Sen. Richard Lugar, R-Ind., on April 20, 2005. Listed as S. 853, the bill was titled "North American Cooperative Security Act: A bill to direct the Secretary of State to establish a program to bolster the mutual security and safety of the United States, Canada, and Mexico, and for other purposes." The bill never emerged from the Senate Foreign Relations Committee.
WND cannot find any congressional committees taking charge for specific oversight of SPP activity.
WND has requested from Word in the U.S. Department of Commerce a complete listing of the contact persons and the participating membership for the working groups listed in the June 2005 SPP report to the trilateral leaders. In addition, WND asked to see all work products, such as memorandums of understanding, letters of intent, and trilateral agreements that are referenced in the report.
Many SPP working groups appear to be working toward achieving specific objectives as defined by a May 2005 Council on Foreign Relations task force report, which presented a blueprint for expanding the SPP agreement into a North American Union that would merge the U.S., Canada and Mexico into a new governmental form.
Referring to the SPP joint declaration, the report, entitled "Building a North American Community," stated:
The Task Force is pleased to provide specific advice on how the partnership can be pursued and realized.
To that end, the Task Force proposes the creation by 2010 of a North American community to enhance security, prosperity, and opportunity. We propose a community based on the principle affirmed in the March 2005 Joint Statement of the three leaders that "our security and prosperity are mutually dependent and complementary." Its boundaries will be defined by a common external tariff and an outer security perimeter within which the movement of people, products, and capital will be legal, orderly, and safe. Its goal will be to guarantee a free, secure, just, and prosperous North America.
The CFR task force report called for establishment of a common security border perimeter around North America by 2010, along with free movement of people, commerce and capital within North America, facilitated by the development of a North American Border Pass that would replace a U.S. passport for travel between the U.S., Canada and Mexico.
Also envisioned by the CFR task force report were a North American court, a North American inter-parliamentary group, a North American executive commission, a North American military defense command, a North American customs office and a North American development bank.

Thus we see the counter-propaganda is back in full gear to save REAL ID, led by the radical revolutionary neocon Trotskyites who hate the Constitution while claiming to "defend freedom". (But why did they say the States could "opt out"? What of the neocons claim of "states rights" now?).What they don't want you to read are the next two articles. These tactics and their sources are important to refute, as they play to the conservative base by distorting all the arguments about REAL ID and turn them into partisan "circle the wagons" conflict.
THIS IS NOT A PARTISAN ISSUE...AS THEY WOULD HAVE IT....AS BOTH REPUBLICAN AND DEMOCRATS IN MANY STATES HAVE PUBLICLY OPPOSED IT. Congress had no authority to pass such anti-constitutional legislation which was rammed through in stealth by attaching it to a "emergency military funding" bill. (Any such legislation passed by craft and stealth, as was the USA PATRIOT ACT(s) as well, should be viewed as highly suspicious).
One of the leading Republicans against REAL ID said this:
‘We must not lose what this nation was founded upon. ‘The Real ID Act is a direct frontal assault on our freedoms.’’
"We're supposed to be a government of, by and for the people. Government's role is to protect citizens' freedom. In this case, they're not doing that. It is a direct frontal assault on the freedom of citizens when [the federal government] wants us to carry a national ID."

He also warned about anything less than a full repeal of REAL ID to prevent federal despotism from the rogue anti-constitutional agency called "Homeland Security":
"My concern is that even if [DHS] waters [the Act] down a bit they will try and accomplish what they want with some other legislation... Homeland Security has total control, with no judicial or legislative control over this. Once they issue this, there is no way of stopping them."
In West Virginia legislation is already pending from both House and Senate that is bi-partisan declaring that West Virginia will not participate (i.e. per constitutional doctrine of Nullification) in REAL ID and instructing the DMV to report any attempts by the Feds or DHS to bring conformity. This is excellent legislation, and consistent with West Virginia's Constitutional articles of Continuity of Government and Internal Government and Police.

Whereas, The federal Real ID Act of 2005 mandates an unfunded national driver's license on the people of West Virginia; and
Whereas, Implementation of the Real ID Act would cost West Virginia taxpayers approximately $65 million; and
Whereas, The Real ID Act national database will invite theft of identity and invasion of privacy; and
Whereas, The Real ID Act will impose inconveniences and higher taxes on West Virginians with no attendant benefit such as protection from terrorism; therefore, be it
Resolved by the Legislature of West Virginia: That the Legislature hereby urges the President of the United States and Congress to repeal the Real ID Act of 2005; and, be it
Further Resolved, That the Clerk is hereby directed to forward a copy of this resolution to the President of the United States, the Secretary of Homeland Security, the Governor of West Virginia, the President of the United States Senate, the Speaker of the United States House of Representatives and each member of West Virginia's congressional delegation.

Note the proposed TEETH in this bill to prevent Homeland Tyranny from dealing directly with the DMV to entice, coerce, or otherwise come in by the back door! The DMV head in 2004 was completely agreeable to implementation. Bill is pending introduction in next session, having cleared judiciary.
§17B-7-1. Legislative finding; prohibiting implementation of "REAL ID Act."
(1) The Legislature finds that the enactment into law by the United States Congress of the "REAL ID Act of 2005", as part of Public Law 109-13, is inimical to security and well-being of the people of West Virginia, will cause unneeded expense and inconvenience to the people of this state, and was adopted by the United States Congress in violation of the principles of federalism contained in the tenth amendment to the United States Constitution.
(2) The State of West Virginia will not participate in the implementation of the "REAL ID Act of 2005." The Department of Transportation, including the Division of Motor Vehicles, is directed not to implement the provisions of the "REAL ID Act of 2005" and to report to the Governor any attempt by agencies or agents of the United States Department of Homeland Security to secure the implementation of the "REAL ID Act of 2005" through the operations of that division.
NOTE: The purpose of this bill is to provide that West Virginia will not participate in the "REAL ID Act of 2005" enacted by the United States Congress in Public Law 109-13.

Here is the "But"....the new Federal Fascism office of Homeland Tyranny still intimidates the States to comply to the federalization of their licenses (national ID cards), which establishes the most draconian data-mining program (interstate, Fed, and Mexico and Canada shared) Orwell ever dreamed of (using biometrics and SSN, thus tapping into anyone's financial, legal, credit, and health records at will) contrary to the 10th and 4th amendments, our precious Bill of Rights, of the Constitution, which defines our freedoms from government intrusion and states rights. (See our previous article below for much more).
The good news is that states now don’t have to comply with Real ID regulations until 2013. The bad news is that states will still have to do all the same things that has made more than 30 of them—including Idaho—pass or submit legislation protesting the act, which is intended to produce a uniform standard for driver’s licenses.
The new deadline was revealed in a 162-page document issued today by the Department of Homeland Security.
States have been protesting a number of the components of the Real ID act, passed a year ago and originally intended to go into effect in May, 2008. Most notably, they are concerned about the $11 billion cost of implementing the program, but civil liberties issues are also a factor. Even Governor Butch Otter, one of the cosponsors of the bill in Congress, is repudiating it.
In fact, DHS said it had received comments from 48 jurisdictions—46 states, plus American Samoa and the District of Columbia.
In addition to extending the deadline—though people whose licenses expire are supposed to get Real ID-compliant licenses before then—DHS said states should adopt an exception policy for people who, through no fault of their own, didn’t have the appropriate documentation—particularly people born before 1935—and that automatic renewal through venues such as the Internet continue to be allowed, if images of the original documents are kept.
While states no longer have to comply with the Act by May, 2008, they are supposed to submit their certification package by February, 2008—90 days before the May 2008 deadline—and in addition are supposed to “communicate their intent to certify compliance or request an extension” by October, 2007. However, such extensions are only intended to last until December, 2009.
As far as the privacy concerns that some people, such as the American Civil Liberties Union, have expressed, DHS essentially said that people shouldn’t be concerned because such information is all collected by the government anyway. “[N]either the Real ID Act nor these proposed regulations gives the Federal Government any greater access to information than it had before.”
Indeed, much of the security requirements appear to be pushed back down to the states. “Each State will be required to prepare a comprehensive security plan for its DMV offices and driver’s license storage and production facilities, databases, and systems utilized for collecting, disseminating or storing information used in the issuance of REAL ID licenses. As part of this requirement, DHS will require that each State include in its annual certification information as to how the State will protect the privacy of the data collected, used, and maintained in connection with REAL ID, including all the source documents.”
However, DHS has determined that the information should be stored on the back of the card in an unencrypted bar code, which DHS admitted is a security hole. “For example, a bar could scan the 2D barcode to verify that the individual presenting the driver’s license or identification card was 21 or over, and at the same time could conceivably obtain the person’s name and address off the barcode and compile a list of names and addresses of its patrons, which it could subsequently sell or use,” the report explained. “DHS...invites comment on how to provide this access and the protection of the information at the same time.”
DHS also gives its own figures and a breakdown of what it expects costs to be, which is $23 billion. States will incur more than 60% of these costs, DHS said.
Much of the rest of the voluminous report is a painstaking description of the documents that will—and will not—be suitable for identification for a Real ID.
DHS is actively seeking comments on the document. Comments can be faxed to the Office of Information and Regulatory Affairs, Office of Management and Budget, Attention: DHS-TSA Desk Officer, at (202) 395-5806.
The Real ID, which is being opposed by more than 30 states, including Montana, [where is West Virginia--"Mountaineers are always free"?] defines a number of requirements for driver’s licenses, including a digital photo, various features intended to keep it from being duplicated, and could potentially include a radio frequency ID chip. In addition, it requires states to link their record-keeping systems to national databases. People who live in states that do not comply with the act will not be able to use their driver’s licenses for boarding an airplane, entering a federal building, or opening some bank accounts.

Typical of all the legislation of this post-9/11 New Government the truth is buried, and openly warred upon, about the fact that this does in fact create a federalized driver's license and a National ID card, that is not constitutionally lawful, is not justified by any evidence (but allegations alone), and will not prevent either terrorism or illegal immigration problems. Neither should State DMVs be turned into Gestapo-type customs and naturalization centers, nor should "free Americans" be pre-booked as criminals upon arrest, their private documents searched and seized, and their biometrics taken, as a condition of driving, let alone to board an aircraft or train. This is the most anti-constitutional and fascist legislation to establish a Police State government that has ever been passed since Lincoln's martial law. Perhaps the best description of REAL ID legislation and what it establishes is by republican Congressman Ron Paul (TX) in his articleNational ID Cards Won't Stop Terrorism or Illegal Immigration. Now the West Virginia constitution reinforces the federal constitution's 10th Amendment in no uncertain terms, anticipating more federalization or attempts at martial law following the Civil War, and makes it a clear duty of the governor to resist any federal "encroachment" upon the state's "internal government and police":
The government of the United States is a government of enumerated [i.e. limited] powers, and all powers not delegated to it, nor inhibited to the states, are reserved to the states or to the people thereof. Among the powers so reserved to the states is their EXCLUSIVE REGULATION OF THEIR OWN INTERNAL GOVERNMENT AND POLICE; AND IT IS THE HIGH AND SOLEMN DUTY OF THE SEVERAL DEPARTMENTS OF GOVERNMENT, CREATED BY THIS CONSTITUTION, TO GUARD AND PROTECT THE PEOPLE OF THIS STATE FROM ALL [FEDERAL] ENCROACHMENTS UPON THE RIGHTS SO RESERVED.

Therefore, it is the "solemn duty" of West Virginia government to "guard and protect" West Virginians, andresist and nullify REAL ID legislationas a federal "encroachment" upon "internal government and police", copying and imitating Montana's Bill of Nullification [pdf] (which the Governor as Chief Magistrate has the executive authority to do himself), and further sue the Federal government for right of "free" West Virginians to travel, fly, take trains, etc. without the Federal "mark" of approval, and freedom from total information surveillance, contrary to the 4th Amendment to be "secure" in our private effects from government intrusion.
