NDAA 2012: Cornerstone of Totalitarianism--"First they came for the [Islamists]..."

Beware of politicians making use of alarmist and inflammatory rhetoric when they propose the "necessity" of new laws "to secure the Homeland".  Here's why, with a familiar quote:

First they came for the Islamists.  Now they are coming for Americans.

Now during the Obama Administration there has been significant talk about "home grown terrorists"--i.e. Americans, instead of just "radical Islamists" coming in from the outside.  It was the Obama Administration's Janet Napolitano (or Napolean-tano) that sent out watch bulletins like these just a few years ago which proves the danger of government assessments about "home grown terrorism".

Ever since 9/11 (that false-flag event done to change America completely as well as its global foreign policy) this blog has pointed out the dangers of America's post-9/11 government and its new unconstitutional superstructure, especially of the new Department of Homeland Tyranny (aka Security; a very fascist, anti-Constitutional Dept. that blends domestic, federal policing, usurping the States, with the Dept. of Defense), the so-called USA PATRIOT ACT (which violates 4th and 5th amendments toward totalitarian surveillance and arrest powers, and destroys personal privacy and makes ID theft easier), and the REAL ID Act (which coerces states to turn drivers licenses into National ID cards with biometrics) to name just three major changes.  All this was done by tricks in legislation and often with "must-pass" defense authorization bills and funding.  Whenever you hear about a "must-pass" piece of legislation in Congress be very worried and read the fine print. 

Well now President Obama signed what he knew was controversial very secretly this last New Year's Eve (while Americans were very distracted) after Congress passed it as "necessary to protect us against terrorism".  Buried in the fine print of the National Defense Appropriations Act of 2012, passed by our totally untrustworthy bipartisan Congress before the end of last year, was the most dangerous and unconstitutional provision that permits the arbitrary and absolute detention of any American citizen based upon the very fallible, and sometimes politically or sinisterly motivated, designation by someone in authority within the Federal government that said individual is a terrorism threat or "material supporter of" such--without grand jury, trial, or even a judge-signed warrant for their arrest.  The purpose of the Constitution is to keep Americans safe from the Government while this dangerous legislation permits the Feds to take any American citizen, by-passing all Constitutional provisions in the Bill of Rights that keeps Americans free. 

The Founding Fathers warned us about governments that do this which is why the wrote a Constitution to prevent it!  This is just another column and support of the creeping totalitarianism being erected in America under the exaggerated threat of "terrorism" (while many more Americans, including West Virginians, are reported in the newspapers to be killing each other daily) since that infamous (and conveniently date-labelled) 9/11 "catalyzing event".  How long will Americans continue to let this happen, while waving flags, by Presidents and Congressmen who have sworn to "defend and uphold (the supreme law of) the Constitution of the United States"?  The truth is that Americans are no longer "free" but like the proverbial gradually-boiling-frog-in-the-pot of a Totalitarian stew.

 When a letter was sent to republican Representative Shelley Moore Capito against this bill in December, this is the letter we received back, fully supporting what President Obama signed on Dec. 31st:

       

But contrary to Rep. Capito's letter, and writing in bold that "American citizens will NOT be detained  under this bill", while she boasted it passed the committee "with my support", the following will prove that this is not the understanding of many from both left and right politically the way this law was written!  Intentions aside, many claim that the law actually gives broad arbitrary powers to any Presidential administration or federal authority to hold any American at will contrary to their Constitutional rights under the 5th amendment.  Let us call witnesses from the right and left and let's also call Fox's Judge Napolitano (3rd video) to give their view to the reader.

We will now prove that this article is neither hyperbole nor partisan whatsoever but is concerned with the real freedom of all Americans under the Constitution by evidence showing growing alarms from both left and right about this tyrannical and sinister legislation.

Why the NDAA is Unconstitutional

Each year, Congress authorizes the budget of the Department of Defense through a National Defense Authorization Act (NDAA). The NDAA of 2012, however, is unlike any previous ones. This year’s legislation contains highly controversial provisions that empower the Armed Forces to engage in civilian law enforcement and to selectively suspend due process and habeas corpus, as well as other rights guaranteed by the 5th and 6th Amendments to the U.S. Constitution, for terror suspects apprehended on U.S. soil. The final version of the bill passed the House on December 14, the Senate the following day (ironically, the 220th birthday of the Bill of Rights). It was signed into law by President Obama on New Year’s Eve. With his signature, for the first time since the Internal Security Act of 1950 and the dark days of the McCarthy era that followed, our government has codified the power of indefinite detention into law.
This pernicious law poses one of the greatest threats to civil liberties in our nation’s history.

All Americans, therefore, should be concerned, yet the U.S. Media has been strangely silent about it.

Bush introduced Preventive War (not truly pre-emptive war upon imminent threat)--a dangerous foreign policy (offensive instead of defensive wars) while now Obama has signed into law Preventive Detention--a dangerous domestic policy.

FOX: Two Eye-Witnesses of "Christmas Bomber" Claim Gov't Agents Enabled Event

Ever since the "Underwear Christmas Bomber" story broke numerous questions came up about just how this very odd individual could have boarded the plane without a passport, how such an innocuous "bomb" could possibly have been successfully detonated, and who really was behind it when this young man is very apparently unintelligent and inept.  But since then Michael Chertoff (former head of Homeland Tyranny, aka Security) has profited much by pushing his company's new and controversial airport body scanners into use by TSA while the very unconstitutional Dept of Homeland Security has continued to expand and the PATRIOT ACT (which violates the 4th amendment for every American) has been extended, and the "war on terrorism" (i.e. Operation "Regime Change" in the Middle East with Israel) has continued under President Obama. 

A local FOX news Detroit station has been following the story closely and especially that two eye-witnesses, Kurt and Lori Haskell (married), and both attorneys, saw the man, and insist that he was given special assistance, and an impotent bomb device, deliberately, by U.S. intelligence agents (perhaps as a drill) that ended up being used for propaganda!  The FBI has no comment.

Big Government's Big Secret: The Homeland Security-Industrial Complex

Most everyone, especially among conservatives, have been complaining vehemently about Big Government with just cause.  However, even with the newly elected West Virginia GOP chairman, Mike Stuart, who claims to be a part of the very undefined "tea party" movement, we have heard no willingness to touch the great Leviathan in government that dwarfs the rest of government spending.  That untouchable part would be what is termed "National Defense" (which largely funds Offensive wars for democracy), which has since that "catalyzing event", Sept. 11th, with bipartisan flag-waving support, added a new fraternal twin domestically called Homeland Security.

This new and very unconstitutional agency cloaked in secrecy is nothing less than the beginning of what could be called (in retort to their propaganda) "Home-Grown Fascism".  And mark this, this is the part of Big Government that the neo-republicans, who claim to stand for the Constitution and "limited government" (we wish!), along with the cowardly democrats, are unwilling to question, challenge its legitimacy, or take the budget knife to thus far, even though most other spending issues are minuscule in comparison.  It's time to stop straining at gnats while swallowing camels.  If republicans in particular believe in constitutional and limited government, and "individual liberty" is still part of their platform (which this Leviathan agency also threatens, trampling the 4th amendment in particular), then its time to put Homeland Security spending out in the open and on the table with budget axes in hand.

Republican Congressman Ron Paul foresaw the Big Government (and Big Brother) coming when Homeland Security was proposed before Congress and warned of what would happen in his article The Homeland Security Monstrosity.  He of course was right while the politically-correct blind supporters of the RINO George W. Bush were wrong.  He has just published a new press release on The Bloated Intelligence Bureaucracy, based on this very issue.

In the video below Former National Security adviser Richard Clark here talks with ABC about what could be called the Homeland Security-Industrial Complex (you heard it here first), its Leviathan and secret budgets and a labyrinth of tentacles that reach across the country while everyone from the White House to Congress looks the other way.  The context of the discussion is the Washington Post's new video report called Top Secret America which is bringing some good national attention to this matter.  Note in particular Clark criticism of the Post's report in not going far enough, i.e. the secret spending and extensive spending through government contractors (outsourced secret spending), and names in particular Booz Allen Hamilton, a major contractor benefiting from Homeland Security and the "war on terror", which is loaded with neoconservatives like James Woolsey.  That was a very strong hint on his part as to where the real attention and scrutiny should be directed.

The Police State Continues to Expand Its Powers

Note the newest technology is being deployed locally where the 4th amendment which defends against unreasonable search or seizure of personal data is trampled, under the usual pretense of "motor vehicle records". The danger to privacy and freedom is greater than this scenario too, for it will not be long before this automated license plate reader will not only pull up vehicle registration and DMV records, but delve into the driver's personal history (via REAL ID or PASS ID data-mining via the SSN number), as the Surveillance State expands.

Whistleblower: NSA Targeted Journalists, Snooped on All U.S. Communications (Wired.com)

Just one day after George W. Bush left office, an NSA whistleblower has revealed that the National Security Agency's warrantless surveillance program targeted U.S. journalists, and vacuumed in all domestic communications of Americans, including, faxes, phone calls and network traffic.

Russell Tice, a former NSA analyst, spoke on Wednesday to MSNBC host Keith Olbermann. Tice has acknowledged in the past being one of the anonymous sources that spoke with The New York Times for its 2005 story on the government's warrantless wiretapping program.

After that story was published, President Bush said in a statement that only people in the United States who were talking with terrorists overseas would have been targeted for surveillance.

But Tice says, in truth, the spying involved a dragnet of all communications, confirming what critics have long assumed.

"The National Security Agency had access to all Americans' communications," he said. "Faxes, phone calls and their computer communications. ... They monitored all communications."

This is powerful testimony from an NSA insider that Bush lied about the extent and purpose of domestic spying being used upon Americans and this report reveals that journalists and media were specifically targeted. All this from a credible source, a former NSA analyst who had first hand knowledge and experience.

The mark of tyrannical governments is paranoia, particularly spying on the press as well as their own citizens.

The Muckraker Report spoke with Rex Tomb, Chief of Investigative Publicity for the FBI. When asked why there is no mention of 9/11 on Bin Laden’s Most Wanted web page, Tomb said, “The reason why 9/11 is not mentioned on Usama Bin Laden’s Most Wanted page is because the FBI has no hard evidence connecting Bin Laden to 9/11.”

Surprised by the ease in which this FBI spokesman made such an astonishing statement, I asked, “How this was possible?” Tomb continued, “Bin Laden has not been formally charged in connection to 9/11.” I asked, “How does that work?” Tomb continued, “The FBI gathers evidence. Once evidence is gathered, it is turned over to the Department of Justice. The Department of Justice than decides whether it has enough evidence to present to a federal grand jury. In the case of the 1998 United States Embassies being bombed, Bin Laden has been formally indicted and charged by a grand jury. He has not been formally indicted and charged in connection with 9/11 because the FBI has no hard evidence connected Bin Laden to 9/11.”

REAL ID, A Real Threat to Gun Rights

Gun Owners of America has stated the same, but this article shows how. Like the Social Security card, now used as a national identifier for non-related purposes, REAL ID would morf beyond its stated purpose (because the SSN is one of its central components). Homeland 'Security claims absolutely arbitrary power to change its usage requirements without Congressional approval (when in fact REAL ID was only approved by tagging it to a war spending bill, without debate!). Congress therefore has created a monster beyond control.

This is another solid reason that Gov. Manchin and the legislature must pass a bill rejecting it without delay, as have a growing number of other states. Next! Liberty is a threatening thing to Homeland Security. If it was really about making drivers licenses secure then the Feds would not care. But it is really about federal power and their matrix of surveillance that they want to construct that is at stake.

West Virginia needs to defend its own and the federal Constitution (4th and 10th amendments), and outlaw and nullify REAL ID in the next legislative session, irregardless of Governor Manchin and the DMV's irresponsible and unjust support of REAL ID, to defend our liberties that began on July 4, 1776.

On Tuesday, Gov. Janet Napolitano signed a measure, House Bill 2677, barring Arizona's compliance with the Real ID program. In so doing, she called it an unfunded federal mandate that would stick states such as Arizona with a multibillion-dollar bill for the cost to develop and implement the series of new fraud-proof identification cards. HB 2677 is a rare recent example of broad, bipartisan agreement at the state Capitol, with the Democratic governor and GOP-led Legislature finding common ground in their opposition to Real ID. Some of that opposition is grounded in concerns about privacy and government advancement toward a national identification card. For Napolitano, the biggest issue is related to Real ID's costs for the states.

West Virginia Conducts Improbable, Expensive Terror Excercise, Evacuation of D.C. Scenario

"The sky is falling, the sky is falling"; Homeland Security plays 'Chicken Little' again, at the cost of West Virginia taxpayers. The probability of this happening is microscopic! See our previous article, "OVERBLOWN", to put all this into more rational perspective.

According to the paranoid propaganda (similar to "mushroom clouds" from Saddam Hussein) we are to believe that "it is not if, but when" the nation's capitol WILL BE attacked, and a mass evacuation forced--because they say so! All of this to see if "radios and communication" work properly? Is this apocalyptic scenario (like catastrophic tides due to global warming) really that probable, or is this more of a psychological operation and way to get West Virginia government to comply with the "war on terrorism" program of Homeland Security? (Gov. Manchin previously conducted a "Flu Pandemic Summit" also in Charleston, another "not if, but when" scenario, and also supports REAL ID while the people and legislators largely oppose it).

Actually, even if a rehearsal were justified, there is a greater probability many would flee to Maryland or southern Virginia, since the interstates more immediately cross those areas, rather than the narrow portion of the West Virginia panhandle, and I-270 is the quickest northern route which would entirely by-pass the portion of I-81 this was conducted at. So even the emphasis on West Virginia does not make sense, which looking at the map shows.

The scenario: A dirty bomb falls somewhere in the Washington D.C. area. Thousands of people evacuate to West Virginia. The state Homeland Security Department staged a major exercise yesterday to test whether West Virginia can handle such a scenario.

In Berkeley County, the local Homeland Security and Emergency Services Department set up a decontamination station on a strip of land between the county’s hospital and Interstate 81.

Shortly after 11 a.m. a West Virginia Emergency Response Team semi truck and trailer pulled up. Members from local fire and emergency services departments worked with members of the National Guard to empty the truck and erect tents where evacuees were decontaminated.

State Military Affairs and Public Safety Deputy Director Christy Morris was on hand to observe.

Arizona State Senator (R): 9/11 Involved Controlled Demolition--Calls for Real Independent Investigation

A republican Senator in Arizona is convinced that controlled demolition was used on 9/11 in the supposed "collapse" of the WTC towers. More and more reasonable persons, scientists, government officials, airline pilots, and architects and engineers are claiming the same thing, appealing to the evidence while the media consistently supports the official story which appeals to nothing but blind faith in what government officials have stated, and an admittedly corrupted 911 Commission Report.

It can no longer be resisted as a mere "conspiracy theory". It is more of a "theory", unsustainable by evidence, that the WTC towers could have collapsed--symmetrically, vertically, and in total pulverization, at almost free fall speed--without controlled demolition, which indeed justifies claims of cover-up and conspiracy.

Backing my claims about 9/11 questions

A recent letter to the editor asked for evidence of my claims regarding the tragedy of 9/11. Below I present some points that are presently known. I won't be able to convince anyone who doesn't want to be convinced, but for those who are willing to deal with factual evidence, consider the following:

• 37 different people reported explosions in the basement of the World Trade Center Towers before the first plane hit, and seismic equipment recorded both the explosions and the impacts. In addition, people were injured by the explosions in the basement, providing well-documented evidence. Yet this evidence is ignored.

•The media and government have promoted the "pancake theory" as the cause of the collapse of the Twin Towers — that is, fire weakened the steel support beams, causing the upper floors to collapse. Then the weight of the collapsing floors above caused the floors below to collapse. This theory is not consistent with scientific principles or the facts. Frank Legge, who has a doctorate in chemistry, and Tony Szamboti, a mechanical engineer, reported in December in the Journal of 9/11 Studies: "It appears therefore that the official concept of a free-fall collapse of the upper portion through the initiation story, due to heat effects from fire, is a fantasy. If the temperature did become high enough for collapse to occur" — and everyone agrees that it did not — "it could not have happened in the observed manner. In particular it could not have been sudden and thus could not have produced the velocity, and hence the momentum and kinetic energy, upon which the official story depends for the second stage of collapse."

• The theory that the buildings collapsed due to controlled-demolition explosives, however, is consistent with scientific principles and the facts. The "demolition" theory, in fact, is the only one which scientists have been able to corroborate. That is, "… all observations are in accord with the use of explosives in a time sequence." (Legge and Szamboti, December, Journal of 9/11 Studies.)

• Peer-reviewed reports indicate that the masses of dust particles created by the disaster contained tiny pieces of metal that had been exposed to both extreme temperatures (higher than could have been produced by a burning office or burning airplane fuel) and extreme pressure (such as an explosion) that would fragment material into minute particles. Official reports ignore this.

• In December, physicist Steven Jones announced the discovery of thermite chips in World Trade Center dust samples. The chemical composition of these chips are an exact match to known thermite samples used in controlled demolitions--— further corroboration that explosive devices were involved.

• Steel support beams recovered from the site of the World Trade Center exhibit cut edges that are characteristic of thermite used to slice steel support beams in building demolitions but are not characteristic of steel beams that have been burned in a fire.

When the 9/11 Commission Report was finally released, it was woefully inadequate. It never even addressed the collapse of Building 7, for example. Former FBI Director Louis Freeh has stated that there are inaccuracies in the report and unanswered questions. Even the two chairmen of the 9/11 Commission — Thomas Kean and Lee Hamilton — have accused the CIA of "obstructing" the commission, and one commissioner, U.S. Sen. Max Cleland, resigned, stating that the commission was "compromised."

Private individuals with specialized knowledge — scientists, engineers, architects, demolitions experts, and the firefighters and police officers who were on the scene on Sept. 11, 2001, have tested theories, constructed models, provided testimony, and dug for the truth about what really happened on 9/11. They have been ignored by media and the government.

The mainstream media parrot the less-than-credible conclusions of the 9/11 Commission without giving any thought to the many omissions and inconsistencies. In a truly free country, the press would ask hard questions and do real investigating, but this is not happening. Only the alternative media, such as Internet news sites, have done any solid investigating.

The events of 9/11 led immediately to the creation of the Department of Homeland Security and passage of the Patriot Act (what double-speak), both of which deprive us of Constitutional rights and have brought us to the brink of becoming a police state. Homeland Security is currently trying to force a national ID card down our throats, although some governors have politely (or not so politely) told Secretary Michael Chertoff where he can go.

If we're going to sacrifice our freedom, there ought to be a very good reason, and we have a right to know what that is. It isn't enough for government to say, "Trust me." It's way past time for Congress to authorize an independent investigation of 9/11 that will consider the mass of new evidence that has been gathered in the past seven years. The longer they stall, the more suspicions grow.

No Convictions, Lack of Evidence on Alleged "Terrorism Plots"

Just a few news stories that are sure to be under-reported and that you will never hear of on local talk radio when talking about "Islamo fascists" and "terrorists that want to kill us", i.e. the propaganda that justifies wars and tyrannical "security" measures to increase surveillance, domestic spying, and things like REAL ID and the PATRIOT ACT. But you did hear about them when stories were splashed liberally that "terrorist plots" were thwarted in the U.S. and Canada from the MSM propaganda machine, that parrots neocon "terrorism experts" or Homeland Security sources.

These stories (collected by CLG's newsfeed) go to show that, like the words "there is no doubt that Saddam has WMD", that allegation and accusation by the government, and the MSM, does not equal truth. The claims of "terrorist threats" are Overblown, irrationally based, paranoid-producing, and propaganda lies (planted FBI agents have been provocateurs in many cases), that cannot hold up under the basic laws of evidence and jurisprudence. The only convictions ever obtained have been through torture and "redacted" testimony. (See our article on the "convicted mastermind of 9/11" here).

Soon you will hear about "terrorist threats" for the summer, or sensational drills or the "inevitable attack on D.C." scenarios (that increase advertising ratings too), especially before elections, so this should be recalled, and their credibility immediately questioned:

Mistrial declared again in U.S. terrorism case

16 Apr 2008 A U.S. judge declared a mistrial on Wednesday for six men accused of joining forces with al Qaeda [al-CIAduh] to blow up the Sears Tower in Chicago as part of an Islamic jihad against the United States. It was the second mistrial declared by U.S. District Court Judge Joan Lenard in the case involving the men from Miami's impoverished Liberty City neighborhood.

REAL ID: Idaho Rejects, Missouri House Opposes, SC Governor Publicly Renounces--While Manchin Holds West Virginians Hostage

More wise States (but not including West Virginia, being held captive by Manchin and the head of DMV) are moving against REAL ID despite the phony "extensions" (measures to coerce compliance) from the Dept. of Homeland Tyranny. Most people, however, are still too ignorant about the issue of what really goes on at DMV (becoming federalized Gestapo outposts) when they are "processed" for their innocent looking drivers license. For when that occurs an entire biometric and data-mining system is then established on them (yes, "free citizens" pre-booked like arrested criminals), including the process of linking of their ID to foreign governments (i.e. Canada and Mexico. Yes, when you cross the border Canadian customs can pull your entire personal record, including occupation, up on their screen, courtesy of the federalized DMV). Meanwhile, the security merchandisers (like Viisage, contracted with West Virginia DMV, apart from legislative or judicial oversight with new privacy invasions) are making a killing, using your tax dollars, at the expense of your personal liberties! Manchin government is more than willing to have the latest hi-tech, privacy-killing, tyrannical ID system to tag, track, and monitor you, and of course have you pay for it under the guise of "public safety". It is more than just West Virginia's official slogan of "Mountaineers are always free" that has been set aside. It is the very constitution and laws defending that which are being abandoned which prevent an intrusive, liberty-killing, over-powerful government that claims the people are its property and tags them like sheep.

People need to read so here is some help. Do not miss Washington Times commentary ("REAL ID Side Effects) below from Gov. Mark Sanford (R - South Carolina), who writes this, which is similar to the position in previous SB248 (the bi-partisan West Virginia senate bill against REAL ID) which got buried by the Governor's minions:

Our greatest homeland security is liberty, and the Founding Fathers believed our greatest threat to liberty was a central government grown too powerful. Accordingly, they set up checks on federal power by vesting authority at the individual and state levels.

REAL ID disrupts this delicate balance of power in two ways. First, it turns the Founders' logic on its head by forcing states to act as agents for the federal government in creating a national ID card for federal purposes. Needing a REAL ID to board a plane or enter a federal building would also change the balance of power in something as seemingly insignificant as a visit to a member of Congress.

Too bad Gov. Manchin is not like this (as he worked to block passage of the anti-REAL ID bill in the House), despite that he swore to "defend and uphold the Constitution" (both State and Federal) upon entry to office! Manchin is either grossly ignorant or willingly defiant of the Constitution, bowing to the federal plea of "necessity". Democrat and republican voters alike should mark his constitutional violation well, which has occurred frequently behind warm smiles.

Along with the articles about Idaho now joining the growing list of anti-REAL ID states, and Missouri on the brink (as well as California), do not miss the blog article from Reasonable Citizen ("Making States Submit to Federal Authority"), who makes a strong case against REAL ID, including this good observation:

But, no, they decided that only the Federal government could set standards and then force the States to comply.... Why is the Federal government forcing this upon people? Because they know that nobody wants a Federal ID system. Nobody.... By forcing the States to do something at a local level, the Federal government can create a Federal ID system without taking any of the heat."

REAL ID: 50 States Citizens Free to Travel; Senators Grill Chertoff for "Bullying" States

This is a good analysis on REAL ID, as there is much posturing going on by the Dept. of Homeland Tyranny (aka Security) as to the results. Bottom line is the States justly rebelled, and the anti-Constitutional Department is compromising, but still pushing. May 11th was the deadline date, but it has been arbitrarily moved, and has no definitive standards. Chertoff s goal is to feign compromise while coercing and gaining increasing conformity.

Members of the Senate Judiciary Committee criticized the Department of Homeland Security yesterday for pressuring reluctant states to adopt new federally approved driver's licenses, with one accusing Secretary Michael Chertoff of "bullying" the states into compliance under a threat of blocking citizens' travel...

..."Bullying the states is not the answer, nor is threatening their citizens' rights to travel," Leahy told Chertoff. "From Maine to Montana , states have said no." Seventeen states passed legislation rejecting Real ID, and DHS has given them until May to comply with the law or find that their driver's licenses would no longer be accepted as federal identification...

The Idaho house also joined the senate in rejecting REAL ID in legislation, which the governor Butch Otter will likely sign. That would make 18 States now rejecting formally, and California is leaning the same way.

Meanwhile in West Virginia, despite that all but 3 Senators voted to not participate in REAL ID as a state, Gov. Manchin is playing the puppet to Washington (instead of upholding his constitutional oaths of office, which we witnessed) and the head of DMV appears to be the leading sycophant for state conformity toward this fascist standard under the plea of "necessity". The House was prevented voting up or town as Rep. Hrutkay (D-Logan), heading the Transportation Committee, ensured it got locked in committee, far from the House floor. Is it not clear that this legislation, with broad bi-partisan support, was killed by Manchin and his loyal sycophants? Gov. Manchin does not want West Virginians to be free, but on a REAL ID data-mining Federal leash. Voters should remember this.

The freedom to travel as free citizens should not, and legally cannot, be impeded. To set up a new criteria for just who will be treated like free citizens , instead of criminal suspects, without probable cause or search warrant, on the basis of a national (i.e. federalized state) ID card is unconstitutional.

Chertoff vs States on REAL ID; South Carolina May Sue Feds

Show down time on REAL ID is here. The official deadline is May 11th for states to file (i.e. beg, for there is no written law about this) for extension from the new extra-constitutional Dept. of Homeland Tyranny. Montana got an extension without asking for one (still refusing to comply), and five Senators requested for all 50 states to be exempt from hassle. Meanwhile, Gestapo chief Chertoff insists that it is Congress that established the deadline, while it had no choice because REAL ID was craftily attached and passed under another "must-pass" military spending bill, and without debate . Chertoff is trying to gain compliance, arbitrarily by compromises, so long as all states eventually comply with his dictates. Tyranny will enter softly.

The big news, and key precedent that the Feds fear, is that South Carolina may justly file a lawsuit against them for treating South Carolinians like non-citizens and terrorists suspects. THIS IS WHAT EVERY STATE SHOULD DO.

WEST VIRGINIA NEEDS TO PASS SB248 AND HAVE THE ATTORNEY GENERAL SUE, PER THE 10TH AND 4TH AMENDMENTS OF THE CONSTITUTION, FOR MOUNTAINEERS TO TRAVEL FREELY WITHOUT THE INTRUSIVE FEDERALIZED STANDARDS OF ID.

If the two sides can't cut a face-saving deal, Chertoff has offered a blunt warning to those critics who claim the government is bluffing. "Showing up at the airport with only a driver's license from such a state will be no better than showing up without identification," he wrote to the senators. "No doubt this will impel many to choose the inconvenience of traveling with a passport." South Carolina Gov. Mark Sanford was considering legal action, and the state's attorney general was preparing an opinion on whether the governor would have a case if he decided to sue the federal government. Critics of the plan say it is too expensive, an invasion of privacy, and won't actually make the country safer.

Idaho makes a gesture to the Feds and Homeland Security about REAL ID, similar to what West Virginia's Senate approved recently in SB248. Unlike Governor Manchin, Idaho's governor, who originally supported REAL ID, now repudiates it!

The Idaho Legislature had passed a joint memorial last year opposing REAL ID, but that bill had no force of law, while this one specifically tells ITD not to implement it and to report to the Governor and the Legislature any federal attempts to force the department to do so. Otter was a cosponsor of the bill when he was in Congress but has since repudiated it as too expensive and an attack on civil liberties.
